On Wednesday, May 14 Governor Sonny Perdue signed into law House Bill 1081, legislation that makes significant improvements in the state's 18-year old conservation use property tax program. The legislation represented the combined efforts of State Representatives Larry O'Neal (R-Warner Robins), Bob Lane (R-Statesboro) and Richard Royal (R-Camilla).
House Bill 1081 adds to CUVA a 'cure' provision that allows an alleged breach of the CUVA covenant to be corrected before a property owner is ejected from the program.
It also prohibits denial of CUVA enrollment just because a single qualified conservation use of the property might not be met, for example, due to a restrictive covenant on the property at the time of purchase. The new language allows CUVA participation if any one of the qualifying uses is met. This provision is designed to stop local governments that have been interpreting CUVA more restrictively than was intended in order to deny CUVA enrollment.
