Revenue department issues draft rules for Forest Land Protection Act
On March 24, the Georgia Department of Revenue released the long-awaited rules that will guide the implementation and enforcement of Georgia's newest forest land conservation use tax reduction program. The Forest Land Protection Act of 2008 became effective on January 1 following the overwhelming approval by Georgia voters of Amendment 1 in November. The state's forest landowners had been delayed in making decisions concerning enrollment of their property because of vital information and critical interpretations contained in the agency's rules.

The draft rules are available for public comment for thirty days. DoR is expected to hold a 'comment meeting' as well some time during the comment period. The Georgia Forestry Association has been in talks with DoR prior to the draft rules' release in an attempt to achieve language that does not create unnecessary obstacles for landowners who wish to enroll.

"The proposed rules will no doubt raise a number of questions, and that is why the public comment period is so important", said Steve McWilliams, spokesman for the Georgia Forestry Association. "It is incumbent upon Georgia's landowners to submit questions and to speak up when they don't agree with Revenue's position," he noted.
